Bethel Lutheran Church Web Site Acceptable Use Policy

With the exception of information specifically authored by or on behalf of Bethel Lutheran Church ("Service Provider"), Service Provider does not develop or publish, nor does Service Provider review, censor or edit the materials and information which are accessible through the Service Provider service networks, or the materials and information which are accessible through the other computer networks which may be connected to the Service Provider service networks. The persons and organizations, including Service Provider members and The Client, who publish materials and information which are accessible through the Service Provider service networks are solely responsible for the content of such materials and information, and are solely responsible to know and to comply with all laws applicable to the publication of such materials and information. Service Provider does not accept responsibility for the content of the materials and information published by others that are accessible through the Service Provider service networks and does not accept responsibility for the violation of any laws resulting from such publication.

Web Publication Guidelines

It is the responsibility of The Client and their constituents who have access to the Service Provider service networks and to the networks of other providers to comply with the Service Provider Web Site Acceptable Use Policy and the acceptable use policies governing those networks. The following guidelines are part of the Service Provider Web Site Acceptable Use Policy. It is the responsibility of all members, subscribers and others who have access to the Service Provider service networks to:

Email Violations

The Client is specifically forbidden from generating unsolicited emails that are sent to numerous addresses in a single email. All mass emails are only to be sent that were obtained as "opt-in" or for members of the Client's services, and are to conform to email specifications to prevent the email from being classified as spam. Specifically, emails are to contain the senders email address on the FROM line, a valid, accurate, and non-misleading SUBJECT line, and the body of the email must contain an accurate and usable method for the recipient to remove themselves from the senders email list.

Violations may lead to suspension or cancellation of email rights and possible web site hosting termination for cause. Additionally, Service Provider reserves the right to impose disciplinary action up to and including the expulsion of the member or subscriber from Service Provider, termination of Service Provider services, and forfeiture of all dues and fees paid to date. Evidence of illegal or prohibited activities may be disclosed to law enforcement authorities. Should The Client's actions result in loss of time or legal fees on Service Provider's behalf, The Client shall be responsible for the payment of these fees.

The Client shall be responsible to distribute, publicize and enforce the Service Provider Web Site Acceptable Use Policy at their sites. In addition, The Client shall provide this policy to appropriate administrative authorities at all sites connected to theirs via connections not directly supported by Service Provider.

Disciplinary Action For Illegal Activity

Even though Service Provider does not review, censor or edit the materials and information which are accessible on the Service Provider service networks or other networks which may be connected to the Service Provider service networks, if Service Provider becomes aware that a Service Provider member or subscriber is in violation of the law or this Web Site Acceptable Use Policy, Service Provider reserves the right to impose disciplinary action up to and including the expulsion of the member or subscriber from Service Provider, termination of Service Provider services, and forfeiture of all dues and fees paid to date. Evidence of illegal or prohibited activities may be disclosed to law enforcement authorities. Should The Client's actions result in loss of time or legal fees on Service Provider's behalf, The Client shall be responsible for the payment of these fees.

Use of Web Hosting Service

The Client and its employees and representatives will use the service solely for The Client's business. The Client will not re-market or assign the services.

In using the services, The Client will comply and will cause The Client's employees and representatives to comply with applicable laws and with the Web Site Acceptable Use Policies adopted by Service Provider from time to time. The Client acknowledges receipt from Service Provider of a copy of the current Web Site Acceptable Use Policy. The Client assumes full responsibility for use of the services by their employees and representatives.

Assumption of Risks

Service Provider will use its best efforts to assure provision of the services to The Client; however, The Client acknowledges notwithstanding such efforts that there can be no assurance of the provision of the service.

Service Provider will not be responsible for any loss or damage incurred by The Client due to interruptions in service, unavailability of service, and non-delivery of data to or from The Client.

In addition to assuming such risks, The Client assumes all risks of damage to The Client's data and equipment and exposure of The Client and its employees and representatives to offensive or objectionable material which may result from The Client accessing the internet. The Client acknowledges that Service Provider does not monitor data which is transmitted through use of Service Provider's services and that there are individuals who may seek improper access to The Client's data or pass viruses to The Client's data.

Notices

Any notice or other communication between Service Provider and The Client shall be in writing or by electronic mail addressed to the party at its address set forth on the Application or such other address as that party may have notified the other of in compliance with this Agreement.

Written communication sent by regular mail shall be deemed given on the third business day following mailing.

Facsimiles and electronic mail shall be deemed given on the first business day following transmission.

Modifications to this policy

Service Provider reserves the right to modify the Acceptable Use policy at any time. Members and subscribers will receive prompt notification of all modifications.

Reproduction of this document for the purposes of distribution to aid compliance is permitted.
